DOJ Special Counsel Moves to Dismiss Federal Prosecutions of Trump; Jack Smith cites longstanding Justice Department policy against prosecuting a sitting president - WSJ
The Wall Street Journal reports on Department of Justice Special Counsel Jack Smith's motion Monday to drop two landmark criminal cases against President-elect Donald Trump. One accused Trump of plotting to overturn the 2020 election, while the other alleged that Trump unlawfully retained classified documents. Smith cited Justice Department policy prohibiting the prosecution of a sitting president.
"'That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the government’s proof, or the merits ...' Smith’s team said in its request to dismiss the election-interference case.
Trump in a social-media post said, 'These cases, like all of the other cases I have been forced to go through, are empty and lawless, and should never have been brought.'"
While expected, Smith’s actions formally marked the end of an unprecedented chapter in U.S. history. Consistent with regulations governing special counsel, Smith apparently will prepare a report on his investigation, which can be made public by the attorney general.
